By inviting Sparkbot to your server or interacting with it, you agree to these Terms of Service as well as Discord’s Terms of Service and Community Guidelines.

2. Eligibility

You must be at least 13 years old, or the minimum digital age of consent in your country. You must comply with all applicable local, state, national, and international laws while using Sparkbot.

3. Acceptable Use

You agree not to use Sparkbot to:

• Illegal activity or content that violates law.
• Harassment, abuse, threats, or hate speech.
• Sharing content that is defamatory, obscene, or infringing on intellectual property.
• Spamming, exploiting bugs, or attempting to disrupt the bot’s service.

We reserve the right to restrict or disable access for users or servers violating these rules.

4. Bot Availability

Sparkbot is provided “as is” with no uptime guarantee. Features may be added, changed, or removed at any time without notice. We are not responsible for downtime, data loss, or interruptions.

5. Limitation of Liability

To the maximum extent permitted by law, Sparkbot and its developers, partners, and affiliates shall not be held liable for:

• Indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill).
• Damages from unauthorized access, hacking, or tampering.
• Errors, bugs, or interruptions of service.
• Content, behavior, or actions of third parties using the bot.
• Any damages exceeding the amount paid to use Sparkbot (typically free), in the 12 months preceding the claim.

Some jurisdictions do not allow exclusions of certain warranties or limitations of liability, so parts of this section may not apply to you.

6. Disclaimer of Warranties

Sparkbot is provided “as is” and “as available” without warranties of any kind. The development team disclaims all representations and warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Guarantees that the bot will function uninterrupted, error-free, secure, or compatible with all systems.
• Assurance that defects will be corrected or that Sparkbot is free from harmful components.
• Advice, information, or assistance obtained through Sparkbot does not create warranties unless stated.

7. Indemnification

By using Sparkbot, you agree to indemnify and hold harmless the developers, affiliates, and partners from any claims, liabilities, damages, or expenses arising out of:

• Your use of the bot or access to its services.
• Your violation of these Terms of Service.
• Your violation of any third-party rights.
• Any content or data submitted through your Discord account.

8. Termination & Changes

You may stop using Sparkbot at any time by removing it from your server. We may suspend or terminate access if you or your server violate these Terms, Discord’s policies, or applicable law. Data deletion requests can be made as outlined in our Privacy Policy. We may update these Terms at any time.
